These terms govern the purchase and use of Dawnlist Job Search ("Dawnlist"), desktop software supplied by Spencer Fields, a sole trader established in the United Kingdom ("we", "us"). You contract with us. By installing, purchasing or continuing to use Dawnlist, you agree to these terms.
Subscriptions are sold inside the application, through the store it was installed from. The Microsoft Store edition is sold and billed by Microsoft under its own terms. If a Mac App Store edition becomes available, it will be sold and billed by Apple under its own terms. Each store handles billing, invoicing, payment processing, and the collection and remittance of sales tax or VAT.
Dawnlist is a subscription, charged monthly at the price shown at checkout plus any applicable tax. It renews automatically each month until cancelled. You can cancel at any time; cancellation takes effect at the end of the period already paid for, and access continues until then. Any change to the price is notified by email at least 30 days before it applies to a renewal. Refunds are set out in our refund policy.
While your subscription is active, we grant you a personal, non-exclusive, non-transferable licence to install and use Dawnlist for your own job search on computers you own or control. Your licence key is personal to you and must not be shared, sold or published.
If you obtained Dawnlist from the Microsoft Store or the Mac App Store, that store's standard licence terms also apply to you. These terms apply in addition to them, and nothing in these terms limits any right that those store terms give you.
Dawnlist uses generative artificial intelligence through an Anthropic API key that you provide and that Anthropic bills to you directly. That account is governed by your own agreement with Anthropic.
You must not use Dawnlist for any unlawful purpose; to send spam or commit fraud; to infringe anyone's intellectual property or privacy; or to interfere with the security of Dawnlist or our services, including by probing, scanning, scraping, introducing malware, tampering with the licensing, or circumventing any usage limit or access control.
Dawnlist uses generative artificial intelligence to assess job postings and to draft messages. You are responsible for the documents you supply and for having the right to supply them, for what you ask Dawnlist to do, and for reviewing every output before you rely on it or send it. Outputs can be inaccurate or incomplete, and they are not legal, financial, career or other professional advice. You must not use Dawnlist to create content that is unlawful, defamatory, harassing, discriminatory or deceptive, to impersonate anyone, to misrepresent your qualifications or experience, or to get round the safeguards built into it. Drafts produced for you are yours to use, provided you do not use them to infringe anyone else's rights. Anyone who believes Dawnlist is being used to infringe their rights, or who sees inappropriate output, can write to Apps@spencerfields.com or use Report AI-generated content in the application. We may restrict features, refuse output or suspend access where that is needed to deal with misuse.
Job postings shown in Dawnlist are licensed from a third-party data provider. They are made available as part of the Dawnlist service, and their use is subject to the restrictions in this section. These restrictions continue to apply to any postings retained after a subscription ends.
Job postings may be viewed, searched, stored and used within Dawnlist for the subscriber’s own job search, including retaining shortlisted postings and any notes, assessments or correspondence created from them.
The job posting data may not be:
Curricula vitae, the fit brief, notes, correspondence and assessments of postings remain the subscriber’s own. Nothing in this section limits what may be done with that material, including material Dawnlist generated from the subscriber’s own history.
Access may be suspended or terminated where these restrictions are breached, and Dawnlist may be required to do so by its own licence. Where a breach requires it, deletion of job posting data held may be requested.
This section continues to apply after a subscription ends, for as long as any job posting data is retained.
Dawnlist, including its software, documentation, branding and the services behind it, is owned by us or our licensors. Your subscription gives you a licence to use it, not ownership of it.
We work to keep Dawnlist and its services running, but we do not guarantee that they will be uninterrupted or error-free, or that any feature or data source will remain available. We may update Dawnlist from time to time.
We may suspend or end your access if you materially breach these terms, if a payment is not made, if there is a security or fraud risk, if our data licence requires it, or for repeated or serious breaches of acceptable use. You may stop using Dawnlist and cancel your subscription at any time.
To the fullest extent permitted by law, Dawnlist is supplied "as is", and our total liability to you is limited to the amount you paid us in the twelve months before the claim. We are not liable for indirect or consequential loss, including lost opportunities, or for decisions you make using Dawnlist's assessments or drafts. Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited, and your statutory rights as a consumer are unaffected.
We may update these terms. The version in force when you buy or renew applies to that period. Material changes will be announced in the application before they take effect, and the date at the top shows the current version.
These terms are governed by the laws of England and Wales, and the courts of England and Wales have jurisdiction, but if you are a consumer living elsewhere you keep the mandatory protections of the law where you live.
